End User License Agreement
1. Nature of License Grant
This End User License Agreement ("EULA") is a legal contract between you ("End User") and Alves Holdings LLC ("Got Nest", "Company") governing your functional deployment of our compiled mobile software application ("Application") acquired via the Apple App Store or Google Play Store.
Subject to your rigorous compliance with this EULA, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and execute one (1) copy of the Application on a mobile device owned or legally controlled by you, solely for your personal home search use (if a Client) or internal professional business operations (if a Texas Agent).
2. App Store Regulatory Compliance Statement
You explicitly acknowledge that this EULA is concluded solely between the End User and the Company, and not with Apple, Inc. or Google LLC.
The Company, and not the respective application store platform, is solely responsible for the licensed software and its constituent data payloads.
Your structural deployment of the mobile application must conform to the current Apple Media Services Terms and Conditions and Google Play Terms of Service.
3. Third-Party Platform Terms Integration
The Application features advanced location mappings and cloud authentication. Your license is conditioned upon your adherence to the mandatory terms of our integrated infrastructure providers:
Mapbox Integration: You must strictly abide by Mapbox's global Acceptable Use Policy and spatial data parameters. No map imagery or location coordinates may be scraped or exported outside the Application framework.
Amazon Web Services (AWS): Your account provisioning, token storage, and session validation must not disrupt or compromise AWS security layers.
MLS Data Restrictions: No property details or display matrices derived from HAR or Cotality may be screenshotted, reformatted, or re-broadcasted for external marketing vectors.
4. Termination of License
This license is active until terminated by either party.
Your legal right to utilize the mobile app terminates immediately and automatically without notice from the Company if you fail to comply with any contractual term of this EULA, violate TREC regulations, execute unauthorized data scraping, or input discriminatory prompt configurations.
Upon termination, you must immediately cease all use of the Application and delete all copies from your hardware devices.
5. Jurisdictional Governing Law
This EULA, alongside all platform operations, shall be construed, interpreted, and governed in accordance with the internal statutes of the State of Texas, without regard to conflict of law principles.
Any legal suit, action, or systemic proceeding arising out of this mobile license must be instituted exclusively in the state or federal courts located in Harris County, Texas.

Because the application delivers generative AI toolsets to assist Texas Agents in servicing Clients, a robust Acceptable Use Policy (AUP) is necessary to mitigate systemic risk.
This document explicitly outlines prohibited use-cases for the AI engine and must bar agents from inputting queries that violate HUD fair housing guidelines (such as asking the AI to rank neighborhoods by demographic density or filter out families with children).
This protects core infrastructure from being classified by regulators as a steering utility and establishes a legal defense framework comparable to market competitors such as Zillow, Redfin, and Homes.com.

If an Agent or consumer uploads a property photograph, marketing description, or structural rendering to the platform that infringes upon a third-party photographer's or brokerage's copyright, the Company could be held liable for direct infringement.
Implementing a public DMCA Copyright Policy allows the Company to claim the "Safe Harbor" protection under 17 U.S.C. § 512, shielding the company from financial damages provided a designated DMCA agent is maintained and clear take-down workflows are established.

The Houston Association of Realtors (HAR) and regional Multiple Listing Services (MLS) maintain explicit rules regarding how electronic listings are displayed via Internet Data Exchange (IDX).

Failing to clearly display these disclosures and respect refresh rates can result in HAR disconnecting your data feeds.
